1. Agreement to Terms

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and 4MINDS2TECH LLC ("Company," "we," "our," or "us"), the owner and operator of the My Sweet Tales product, regarding your use of the My Sweet Tales mobile application and related services (collectively, the "Service"). code1to1 is a separate company that provides software engineering, cloud infrastructure, and AI technology services to 4MINDS2TECH LLC.

By downloading, installing, accessing, or using our Service, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use the Service and may not access or use any portion thereof.

2. Description of Service

My Sweet Tales is a mobile application that enables users to create personalized stories with AI-generated content, including the ability to clone voices for audio storytelling. Our Service includes:

• Story creation and customization tools
• Voice cloning and audio generation technology
• Story storage and management
• Access to classic and community-generated stories
• Credit-based features and content

3. User Accounts and Registration

3.1 Account Creation

To access certain features of our Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Requirements

• You must be at least 18 years old, or the age of legal majority where you live, to create or manage an account
• Children may listen to or read stories with an adult, but may not independently create an account, purchase credits, publish content, or submit a voice
• You may only maintain one account
• Accounts are non-transferable

4. Acceptable Use

4.1 Permitted Uses

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may:

• Create stories for personal, non-commercial use
• Share stories within the My Sweet Tales community
• Use voice cloning features for personal storytelling

4.2 Prohibited Uses

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Create content that is illegal, harmful, threatening, abusive, or discriminatory
• Impersonate any person or entity
• Use another person's voice without permission
• Generate content for fraudulent or deceptive purposes
• Attempt to reverse engineer, decompile, or disassemble the Service
• Introduce viruses, malware, or harmful code
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without authorization
• Resell or redistribute access to the Service
• Create content that targets or exploits children inappropriately

5. Voice Cloning and Audio Content

5.1 Voice Cloning Authorization

By using our voice cloning features, you acknowledge and agree:

• You have the right to clone the voice you are recording
• You will not clone voices without explicit permission from the voice owner
• You will not submit a minor's voice unless My Sweet Tales provides and you complete a separate legally sufficient parental-verification process
• You will not use voice clones for unlawful or fraudulent purposes
• You understand that voice data will be processed and stored on our servers
• You grant us a license to store, process, and use your voice data to provide the Service

5.2 Responsibility for Voice Content

You are solely responsible for:

• Obtaining all necessary permissions to clone and use voices
• Ensuring your use of voice clones complies with applicable laws
• The content generated using your voice clones

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of the stories and content you create ("User Content"). However, by creating content on our platform, you grant us:

• A worldwide, non-exclusive, royalty-free license to use, store, and display your User Content
• The right to reproduce, modify, and distribute your User Content to provide the Service
• The right to use your User Content for improving our algorithms (anonymized where possible)

6.2 Our Content

The Service itself, including its original content, features, and functionality, is owned by 4MINDS2TECH LLC and protected by applicable copyright, trademark, patent, and other intellectual property laws.

6.3 Third-Party Content

Our Service may include content from third parties, including:

• Classic stories and public domain content
• User-generated content from the community
• AI-generated content based on various sources

7. Digital Credits and Payments

7.1 Coin Packages

The Service may offer consumable digital credits ("coins") that can be used only within My Sweet Tales. Coins are non-transferable, have no cash value, and may not be redeemed for money except where required by law.

7.2 Billing

• Purchases made in the iOS app are processed by Apple through In-App Purchase
• Purchases made on Android or the web may be processed by Stripe or another payment provider identified at checkout
• Platform prices may differ; the price and currency displayed before confirmation control the purchase
• We do not receive or store your complete payment-card number
• You authorize the applicable payment provider to charge the payment method you select

7.3 Refunds

Refund requests are handled under the rules of the payment provider that processed the purchase, including Apple, Google, or Stripe, as applicable. Except where required by law or the payment provider's rules, completed purchases of consumable coins are final.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information, including biometric voice data.

9. AI and Technology Disclaimer

9.2 Service Availability

We do not guarantee that the Service will be available at all times or that it will be error-free. Service may be interrupted for maintenance, updates, or technical reasons.

10. Disclaimers and Limitation of Liability

10.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MY SWEET TALES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, DATA LOSS, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

10.3 Maximum Liability

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless My Sweet Tales, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including attorney's fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your violation of any third-party rights

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or through your account settings.

12.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Engage in payment fraud or fail to pay amounts properly due
• Use the Service in a way that harms us or other users

12.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• All licenses and rights granted to you terminate
• We may delete your account and data (subject to legal requirements)

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law provisions, except where applicable consumer law requires otherwise.

13.2 Dispute Resolution

Before filing a formal claim, please contact us and allow a reasonable opportunity to resolve the dispute. Any unresolved dispute will be handled by a court of competent jurisdiction, subject to applicable law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 4MINDS2TECH LLC regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

15.4 Assignment

You may not assign these Terms or your rights hereunder. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
